These terms are a contract between you and CuddleCut (Serhat Camici, 3901-561 Sherbourne St, Toronto ON M4X 0A1, Canada) when you use cuddlecut.com or buy from us.

The product

We sell a custom photo-shaped pillow with a 15-second voice chip. You upload a photo. Our team cuts the pillow to that photo. You record the voice on the chip after it arrives, by pressing the black button on the white zipper module on the back.

Your photo

You confirm you have the right to use the photo (and the people or pets in it) for this print. You give us a licence to send the file to our print factory and to use it only to make and, if needed, remake your order. We do not sell your photos. We may refuse or cancel an order that uses someone else’s photo without permission, or that we reasonably see as illegal or abusive.

Price and payment

Prices are in Canadian dollars and shown at checkout. Payment is taken by Shopify Payments, Shop Pay, or PayPal. An order is accepted when payment clears.

Production and shipping

Lead times and destinations are in our Shipping policy. Custom goods start production after payment. Risk of loss passes to you when the carrier has the parcel, except where Canadian consumer law says otherwise.

Refunds

Refunds and replacements follow our Refund policy. That policy is part of these terms.

Liability

To the extent Ontario law allows, we are not liable for lost profits or indirect loss, and our total liability for an order is the amount you paid for that order. This does not limit liability that the law does not let us limit, including death or personal injury caused by negligence, or fraud.

Law

These terms are governed by the laws of Ontario and Canada. Courts in Toronto, Ontario have exclusive jurisdiction, except that you may bring a claim in your home province if Canadian consumer law gives you that right.
